In an effort to prevent drownings, Scottsdale has implemented barrier requirements for short-term rental properties that include a pool, hot tub or spa.

To be in compliance with Scottsdale’s requirements (S.R.C. §18-175(g), S.R.C. §31-16 and S.R.C. Chapter 31, Article XIII – International Swimming Pool and Spa Code) these properties must have the following:

Primary Barrier

  • A primary 60” perimeter fence, unable to be easily climbed, that prevents public access (ex. a block wall that surrounds the backyard).
  • Perimeter gates must be self-closing, self-latching with the latch placed at least 54” in height.
  • Vehicle gates must be locked.

Secondary Barrier

Additionally, the property must have a secondary barrier that restricts access to the pool itself. This may be either a separate pool fence or audible alarm system on doors and windows leading to the pool area.

If the property has a separate pool fence:

  • The fence must be 60” high, unable to be easily climbed
  • The pool barrier gate’s latch must be placed at least 54” in height and must be equipped to accommodate a locking mechanism.
  • If a spa or hot tub is outside the pool’s barrier, it must have a lockable cover.

If an alarm system serves as the secondary barrier, all doors and windows providing direct access to the pool, hot tub or spa must equipped with audible alarms.

Failure to comply with these requirements may result in the homeowner and STR operator being cited for safety violations related to the city’s pool barrier requirements.
